General overview of our privacy notice
Your privacy is important to us, and we are committed to protecting it whenever you interact with us. This notice applies to personal information/data you provide to SMART DEVELOPERS (“Smart Developers”, “we”, “us”). It also explains the purposes for which we collect your data and how we process it in compliance with the Data Protection Act, 2012 (Act 843) of Ghana.

Where we build or host software for a client, the client is usually the data controller for the data held in that software, and we process it on their behalf under our agreement with them.
How do we obtain your personal data?
The nature of the data we collect depends on how you interact with us. We may obtain personal information from you when you:
- make an enquiry or send us a message through our website, by email, phone or WhatsApp
- request a quote, proposal or demonstration of our software
- become a client, or act as a contact person for a client organisation
- use software we provide or support, or contact us for support
- apply for a job or internship with us, or send us your CV
- register for or attend an event, training session or workshop
- interact with us in any other way
Purpose of processing and lawfulness
We ensure at all times that personal data we obtain is processed in a lawful and reasonable manner, and without infringing your privacy rights guaranteed under the Act. We will only process personal data where the purpose is necessary, relevant and not excessive, and we will use your information for the purposes for which we obtained it — for example, to reply to your enquiry, prepare a proposal, deliver and support our services, or consider a job application.
Your consent
We will not process your personal data without your prior consent unless the processing is necessary for the performance of a contract to which you are a party or is otherwise permitted under applicable law.
Where we rely on your consent to process your personal data, you can withdraw it at any time. If you withdraw your consent, we may not be able to provide certain services to you, and we will tell you if this is the case at the time.
Retention (how long we keep your personal data)
We will not keep your data for longer than is necessary to achieve the purposes for which we process it, and in line with our retention practices. At the end of the retention period, your data will be deleted or anonymised so that it can only be used in a non-identifiable way, for example for statistics and planning.
Personal data disclosures
We will only disclose information you provide to us with your consent, where the disclosure is required by law, or where it is necessary for the purpose for which you provided it. We will not make your information available to a third party unless this is necessary to provide a service you have requested — such as the hosting, email or payment providers we use to run our services — or we are required to do so under Act 843 or other relevant laws, treaties, agreements or conventions.
Your rights
You have rights under the Data Protection Act, 2012 (Act 843), and you can exercise them by giving written notice to us at [email protected]. We will endeavour to respond within twenty-one (21) days of receiving your notice.
The right to object to processing
You have the right to object to us processing your data in the manner described in this policy, particularly where we rely on legitimate interests and you believe the processing affects your fundamental rights and freedoms.
Request for access to data
You can request a description of the personal data we hold about you and information about the third parties (or categories of third parties) who have access to it. We may ask for information to confirm your identity before responding.
Right to request restriction of processing
You may ask us to restrict or suspend processing of your personal data if:
- you want us to establish the data’s accuracy;
- our use of the data is unlawful, but you do not want us to erase it;
- you need us to hold the data even if we no longer require it, because you need it to establish, exercise or defend legal claims; or
- you have objected to our use of your data, but we need to verify whether we have overriding legitimate grounds to continue using it.
Right to rectification, deletion and destruction
You have the right to ask us to correct personal data that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading, obtained unlawfully or incompatible with legitimate purposes. You may also ask us to destroy or delete personal data where we no longer have your consent to keep it, subject to legal requirements.
Our responsibilities
We have a responsibility to protect your privacy and any personal data we obtain through your interactions with us. We will take steps to ensure that personal data is complete, accurate, up to date and not misleading, having regard to the purposes for which we collect or process it.
Security measures and cookies
We use appropriate technical and organisational measures to protect personal data, including encrypted connections, access controls and backups. Our website uses cookies that are needed for it to work, such as keeping forms secure. You can set your browser to notify you when cookies are used or to reject them; however, this may affect how some pages work.
Our commitment to you
We are committed to managing and safeguarding your personal information. We are guided by Act 843 and follow general principles of data protection and international best practice. We will endeavour to keep your data accurate and secure.
